So I could get a section 59 for parking up and listening to the Cure or Morrissey at a hige volume to kill time before a job?

No... I said it was issued for DRIVING anti-socially. If you read the post carefully, you'll see that it says sitting in a car with the engine off isn't a S59 offence.

Hmm Tactical, can you explain this; me and my 3 mates got "Markers" apparently paperless S59's for driving from bobbing mcdonalds to kfc.

We drove as sensible as possiable indicators and all; considering we were stuck behind a lorry up staplehurst. We arrived at our destination (as great as it was) and an undercover in a silver pug pulls up tells us we were street racing; then issues all 3 cars and drivers with Markers, and cause they are paperless we cannot contest them

Never heard of that before

When you say they "issued" 3 markers - you mean they just said it verbally and didn't give you any physical bit of paper?

Ya , the bloke said its similar to a section 59; if we were to be caught driving dodgy then the cars would be taken away. Basically i figure its just a new way for the police to get more young lads of the street because you cant contest it; and the bloke said you could get car taken away for not using an indicator.

Ahhhh... it's possible but not something I use.

The indicator thing is a bit silly, but the "marker" could be used by coppers.

a friend of mine got one for returning to his car with food bought in mcdonalds.... he was parked in mcd's carpark, went in and got some food, came back with the food to get in the car and eat it (friends of his were in the car)... Before he could get in he was collared (sp?) by a copper and him and the drivers of the 2 other cars next to him got S59's...

i think the other cars were playing loud music, but were defiantely parked with engines off, they were already recieveing s59's when my mate returned

a case of wrong place, wrong time?? dunno, but either way someone needs to shove these s59's up the plod's ass (not every plod of course, but some examples in this thread clearly show that the power is being abused and the rules regarding s59's are being bent)

I would take my time off the receipt and the time off the section 59 and defend my case.

However stories do seem to get distored when people want to look innocent.

I got an ASBO warning which from this thread i believe is similiar to your S59, IT was for excessive noise which I can accept full blame for as my corsa used to be Loud Loud, but as you put one report to a charge or caution etc Mine was a report based on excessive noise from my sound system which again it was my fault as It too was quite loud and my boot was open, We were about a 1/4 mile from the village in a car park but still I can accept fault. Would of thought it wouldn't have been driving related but I didn't complain as my exhaust system would have inevitably got me one.

However what I dont like is that it goes down as careless driving? I suppose its inconsiderate to pedestrians etc if your car is excessively noisy but the fact that i'm seen to be a careless driver, to the police, due to noise annoys me.
But i'm not one to complain and have jsut accepted it and glad it wasn't something worse

Alot of people dont know, some insurance companies wont cover you fiy uo have a section 59 or an asbo.

yeh, i hear what you're saying, i wasnt there, so im only repeating what i've been told... as far as i know he hasnt bothered fighting it, so you never know, maybe it was a bit exaggerated, lol.

Maybe its a prime hunting ground for police to snoop around looking for S59 contenders...

TJ, or any other police officer, do officers have a certain "quota" like most people make out, or is this a load of bull... Like speeding tickets, is there actually a monthly "target" to fulfill...

I've issued 3 warnings and seized 2 vehicles... in 2 years of service.

There is no target for S59.



As I keep saying - if you don't feel as though you've deserved it, contest it.

On the flip side, if you have been a c*ck, accept it and don't do it again!

In fairness, I have never been given a receipt at MacDonalds.


I have heard of these markers being used to stop people from returning to the same place in 48hrs. There is a stretch of road that leads to the beach (As soon as I remember the damn name), if you are stopped and deemed to be "cruising" police have the right to tell you to go home and not return for 48 hours.

In fact if you return, your car can be seized and crushed.

I just hope this is used for it's actual purpose, and not to target young drivers or modified cars.

It does worry me, not that I do anything wrong, I never go "cruising" but as soon as an accusation is made by a police officer I then have to prove otherwise, i.e. Are you cruising? No. Prove it. Bam.

Seems like you have to have an alibi for everything these days.

The whole innocent until proven guilty thing just doesnt come into it much these days... its more along the lines of "guilty of something minor until we can prove you were doing something more important"

Human Rights Act
Article 20.
(1) Everyone has the right to freedom of peaceful assembly and association.


Unfortunately, Section 27 of the Violent Crime Reduction Act 2006 means that Police Officers have the power to "ban" you from a particular place for up to 48 hours (longer if authorised by a superior ranking officer). Again, this power was created for the reasonable purpose of reducing VIOLENT CRIME but... loopholes mean it can be used to move cruisers on

It's one of those things - even I get funny looks off the old bill... and some of them work at the same nick as me!

Just don't give officers any reason to take your car.



I'm hoping to start a new project at work, whereby police and cruisers actually try to build a relationship, rather than keep fighting with each other. It makes much more sense to try and get along, because that way mutual respect breeds better behaviour!
