Tactical maybe you can help lol, i got a £30 fine for parking under bobbing bridge when it was raining a while back now, i see lorries and other cars there parked all the time and i might add there is a drop kurb there. So the officer fined us for "Driving offroad" and when we contested about the drop kurb he then changed it to crossing a path; and then i suggested so im not allowed to cross a path to access my drive which i think slighly wound him up as i was not intentionally disproving what he was fining me for. Any ideas or know if this is infact illegal to park there etc or was i suppos eto be given a warning first or something.

there are no markings to suggest no parking no double lines or single lines nothing of that sort and was about a meter from the pavement same distance my car would be if parked on the drive, what made me laugh was to stop us going anywhere he parked in front of us on the pavement and a elderly lady had to walk in the roundabout to go round his police car

forgot to say, wasnt parked on the pavment at all

This seems failrly common sense to me. I would guess that Mcdeathburger would probably attract a "certain clientel" a high percentage of younger divers which would naturally man more newer and possibly less careful drivers. ( Not having a pop at anyone here, and yes I am an old fart ).
Basically no-one wants to be next to a doughnut pulling doughnuts in a car park when you got young kids in the car.

Yea but the way they are treating it as is every car with alloys and exhaust is a boy racer and they are careless, where as thats just mainly idiots who are careless some of us are geniune safe and take care in our driving. its becoming steriotypical of police , no offence but are they that good at there job that there are no more real criminals to catch.

Relevant part of Section 59: Section 34 of the Road Traffic Act 1988 - Driving elsewhere other than a road.

Advice: don't go around driving off-road like a prat (unless you have permission to!)

Just a few quick questions on this.

What if you are driving on private land, with permission...i.e a field or something similar and you're pulling handbrake skids and donuts?
Can you be issued with a section 59 even if you do have permission to be on the land?

When you reffer to section 34, driving elsewhere other than a road, is this for private land as well or just public land?

If you're just driving on private land, then you state that unless you have permission from the land owner you can recieve a section 59, but how would they prove you don't have permission. By your words they can only issue it without permission, so they would have to prove you don't have permission first?

Sorry to sound pedantic, but where in live there is lots of private land all around me. We usually take 4x4's on it and motorbikes on it to thrash. The last time the land owner was around he said verbally he didn't mind, but that was a good few years ago.

No, it doesn't have to be issued there and then - I've had cars speed off from me, so it's impossible to issue the warning. Just because you drive off, doesn't mean you get away with it.

If you have permission, it's fine, BUT it's down to you to prove you have permission. If you're driving around, make sure you have the land owner's contact details with you.
